The rule

Under the Condominium Act §19bis, foreigners may own up to 49% of the total unit floor area of a registered condominium. For this building that is 49% of 5,720 m² — the figure below. Every unit still open to a foreign buyer is flagged on the stack plan.

The written commitment

Node Living will not accept a foreign reservation once the running committed total would exceed the quota. The clause is in the reservation agreement and is reproduced below. If the quota closes before a foreign buyer signs a contract, the reservation fee is refunded in full.

If you cannot get quota

If you cannot get quota in this building, here is what is actually possible — and what we will not arrange.

Through a Thai spouse

The Thai spouse buys in their own name. Both sign the Land Office declaration that the purchase funds are the Thai spouse’s separate property.

A 30-year registered lease

The unit owner agrees a 30-year lease registered against the unit title. It is a lease, not ownership — no automatic renewal.

The nominee-company structure Node Living will not arrange

Setting up a Thai company with nominee shareholders so a foreigner controls a unit past the quota is illegal under the Land Code §96bis. Node Living does not sell into it, and for any company buyer requires evidence of the shareholders’ real capital contribution.

If none of these works

This unit is not available to you, and we will say so — rather than route you into a structure that fails on audit.
